Connected Community Services Terms & Conditions - Public Wi-Fi, SmartTown
Citizens Telephone Cooperative (“Citizens”) is pleased to deploy various community Wi-Fi products, including but not limited to SmartTown (collectively referred to as Connected Community Services), available to Citizens Subscribers and other authorized users in accordance with these Terms of Use (“Terms”). These Terms incorporate the Citizens Terms and Conditions, including but not limited to Residential Service Terms & Conditions, Commercial Customer Service Agreement - Citizens, Acceptable Use Policy - Citizens, and Privacy Policy - Citizens (collectively called “Citizens Terms & Conditions”).
Your use of any Connected Community Service is your acknowledgment that you have read and agreed to these Terms. Capitalized terms used herein without definition shall have the same meaning as assigned in the Citizens Terms.
At any time, you may use this link to opt out of using Connected Community Services and of the Citizens-Supplied Equipment in your home or business to be used to support Connected Community Services. You understand that your participation in Connected Community Services is not required to receive Services (as defined in the Citizens Terms).
Access to and Use of Connected Community Services
You understand that the Connected Community Services are a feature of Citizens’ Internet service, and that, unless you opt out of Connected Community Services, Citizens may use Citizens-Supplied Equipment (as defined in the Citizens terms) located in your home and/or business to provide Connected Community Services to other Citizens Subscribers and authorized third parties. The Connected Community Services utilize excess bandwidth and, when functioning normally, will not impact, impair, or otherwise alter the speed or quality of your Internet or other Citizens services. Citizens-supplied equipment does not have its own supply of power, and you are required to provide electricity for the Citizens-supplied equipment. You agree that Citizens is not liable for any expenses related to electrical power used by Citizens-supplied equipment. You understand that SmartTown participants’ traffic is securely segregated from the subscriber’s home Wi-Fi traffic and does not impact the subscriber’s data usage plan. SmartTown participants’ traffic is invisible to the subscriber, and the subscriber’s home Wi-Fi traffic is invisible to SmartTown participants
To access a Connected Community Service, you must follow the procedure set by Citizens. You acknowledge and agree that you will be responsible for all activities during any session using Connected Community Services. You may not provide any third party with your credentials to access Connected Community Services. You may use the Connected Community Services solely for your own lawful personal purposes in accordance with the applicable Citizens Terms. You may not in any way distribute, resell, or otherwise provide third parties with access to or use of Connected Community Services.
You agree that your use of the Connected Community Services may be terminated or suspended by Citizens or its technology partners at any time and for any reason.
Performance of Connected Community Services
In order to use Connected Community Services, you must have a Wi-Fi-capable device that:
- meets U.S. and other applicable technical standards;
- is subscribed to Connected Community Service(s);
- renders web pages in a standard HTML browser application;
- runs the IP protocol; and
- is configured to obtain web addresses automatically.
The Wi-Fi device must be in close enough proximity to the Connected Community Service’s wireless access points to achieve connectivity with the Connected Community Service.
Actual Connected Community Services coverage, locations, and quality may vary.
You agree that Citizens will use commercially reasonable efforts to provide useful and reliable Connected Community Services, but acknowledge that the Connected Community Services utilize public, unlicensed radio-frequency spectrum. As such, the Connected Community Services are subject to external interferences, environmental influences, and other factors and variables beyond our reasonable control. Performance and availability may vary, including but not limited to, or affected by,
- transmission and download speed and accuracy;
- network congestion;
- performance, configuration, and functionality of your WiFi devices and wireless cards (including, but not limited to, memory, storage, and other limitations);
- physical obstructions and distances between your WiFi device and the Connected Community Services;
- availability of electric power;
- collocation failures;
- transmission and equipment limitations, failures, maintenance, or repair; and
- user error
Connected Community Services may also be interrupted, refused, limited, or terminated for these or any other reason. Citizens is not responsible for data lost or misdirected due to these and other foreseeable and unforeseeable factors. Network speed is an estimate and is no indication of the speed at which your WiFi device or the Connected Community Services will operate. Actual network speed and other performance will vary.
In order to maintain acceptable levels of service for all Connected Community Services users and to improve this service, we reserve the right to monitor use of the Connected Community Services and to make such adjustments to the use of such services as necessary to maximize the benefit and enjoyment for all Connected Community Services users. Additionally, the Connected Community Services service may use automated processes to monitor and scan communications over the Connected Community Services in order to maintain and provide services, improve your experience, ensure the integrity of your communications, convey messages related to your account, deliver relevant advertising, and for various other purposes related to the provision of Connected Community Services.
Connected Community Services and Citizens
Connected Community Services may allow you to automatically connect to hotspots after you register a compatible mobile device. Thereafter, a properly pre-registered mobile device will automatically connect when in range of a Connected Community Service hotspot using the provisioned credentials.
Service Subject To Interception and Unauthorized Use
You acknowledge that communications over the Connected Community Services may be subject to interception by unauthorized third parties. Although Citizens uses commercially reasonable efforts to provide you with a secure and reliable service, your use of Connected Community Services is AS IS and AS AVAILABLE, and we cannot and do not make any general or specific warranties regarding the security, availability, performance, or other functionality of Connected Community Services. You are responsible for implementing your own security protections while using a Connected Community Service. In the event you become aware of any unauthorized use of a Connected Community Service or any other security breach (including but not limited to third-party use of your Citizens ID and password), you agree to immediately notify us. Citizens expressly disclaims any responsibility or liability for your use of a Connected Community Service and for any lack of security that may result from your use of Connected Community Services. You agree to hold Citizens harmless for the loss of any file, data, or other information while using the Service, and for any unauthorized access to or utilization by any third party of any of your personal, financial, or other sensitive information. If you are in possession of one or more “protected computers” as defined by 18 U.S.C.S. § 1030, you understand and agree to immediately report any impairment in your availability of data to the proper authorities as required by applicable law or regulation.
You further agree that you will not seek to hold Citizens responsible in any way for any third-party website content or the operation of any third-party website accessed via a Connected Community Services, or for the appearance of our “watermark” over a portion of any website.
Changes to Connected Community Services and these Terms
You agree that Citizens may, for any reason, and without notice to you, modify or terminate any Connected Community Services and these Terms without liability to you, any user, or any third party.
We urge you to review these Terms of Use periodically so that you will be aware of any modifications.
